Eight EU Countries Demand a ‘Market Freeze’ on New Nicotine Products

No new nicotine products. Period. That is the opening demand in a joint letter from eight EU health ministers, which asks Brussels to freeze the entire nicotine market while the Tobacco Products Directive is rewritten.

Sent on October 6, 2026, by Dutch Health Minister Sophie Hermans, the letter is addressed to Health Commissioner Olivér Várhelyi and published by the Dutch government. It is signed by the health ministers of the Netherlands, Belgium, Finland, France, Hungary, Latvia, Slovenia, and Spain.

The centerpiece is what the ministers call a “market freeze”. Under their proposal, the revised Tobacco Products Directive (TPD) and Tobacco Advertising Directive (TAD) would block the entry of any new nicotine products, nicotine analogs, or dedicated delivery devices, plus nicotine-free products that mimic nicotine delivery systems. Nothing new would reach European shelves while the rules are being redrawn.

For products already on the market, the letter goes further. It calls for strict nicotine limits, broad flavor bans, standardized or plain packaging, standardized devices, a full advertising ban that covers influencer content, restrictions on cross-border online sales, and the right for member states to ban nicotine pouches and disposables outright.

Then comes the endgame. The ministers say the revised legislation should ultimately aim at “phasing out nicotine dependence across the EU”. That language goes well beyond youth protection or harm reduction. It is a stated goal of ending nicotine use itself.

What does this mean for vapers? In the short term, very little changes: the letter is a political position, not a law. The European Commission is expected to present its proposal by the end of 2026, and any new rules would still need approval from Parliament and member states. But the direction of travel is unmistakable, and the bloc’s strictest governments are now coordinating their demands in writing.

The contrast with the United States is sharp. While Brussels talks about freezing the market, Washington’s FDA runs an authorization pathway, with a growing list of FDA-authorized vapes for 2026 that passed marketing review. Meanwhile, individual US states are writing their own rules, as seen in Texas, where enforcement against unauthorized products is already in motion.
